This privacy policy’s objective is to lay out the rules for how the information and data given by natural and/or legal persons (“User” or “You”) will be used, visiting https://eleviate.io/ (the “Website”) or downloading Eleviate application (“Application” or “App”) provided by EleviateAI OÜ (“the Company”) incorporated in Estonia,  registered at the address Harju maakond, Tallinn, Kesklinna linnaosa, Sakala tn 7-2, 1014. This Privacy Policy is an annex and an inseparable part of the User Contract executed with the User, and it applies when you visit or use the Website, download or use the Application, or related services (the “Services”).

What Information Do We Need to Process?

We obtain certain data directly from you, such as but not restricted to the details you supply to answer the inquiries we pose. Additionally, we collect your personal information from other sources, such as details on your social media profiles you link to our Website and/or Application. We also automatically gather some information, such as details about your device and the parts of our Services that you use most frequently.

The Information We Collect Directly From You

When you create a profile, we may ask you for personal details such as your name, email address, password, and birthdate (“Profile Data”). Additionally, we could provide you the chance to add more details about yourself, such as a photo and any notes you include in the “My Notes” part of the Application.

A third-party payment service processes payments made to us. We do not save any financial data, including credit card numbers, in conjunction with processing such payments. Instead, we give all such information to our third-party processor directly. Therefore, your payment information is kept on our behalf by the third-party processor in these situations.

You may receive an invitation to fill out a form or survey, give your testimony, participate in a promotion (like a contest or challenge), or create user-generated content (like podcasts). This could be through our Service or a third-party platform, like Typeform. We collect and store the information you supply as a condition of participation, such as your name, email address, date of birth, and/or phone number. 

The mentioned data is and will continue to be governed by the terms of this privacy statement unless there is a conflict with the terms of a campaign or another more detailed privacy statement that will also be brought to your knowledge. We may gather, store, and publish your photo with your express agreement to share your testimonies with others via the Application, the Website, or email bulletin. The third party’s privacy policy shall be applicable when we utilize a 3rd platform to conduct a survey or run a campaign.

Whether or not you have created a profile, if you contact us for support or to report an issue or concern, we will record and store your data. This includes your name, email address, location, language preference, operating system, IP address, and any other information you give us voluntarily or that we automatically collect. Following the terms of this Privacy Policy, we use your information to address your questions or concerns and to react to you.

The Information We Collect From Third Parties

We may use your social media profiles or other online accounts that you have allowed to be linked to the Application to get specific information about you. For example, suppose you log in to the Application using Facebook or another third-party platform or Service. In that case, we ask for your permission to access certain information already provided under that account. Such information includes your name, birthday, profile picture, account ID number, email address, and physical location of your access devices.

The platforms and services make information accessible to us through their APIs. Therefore, the information provided to us is constrained by the platform or Service’s privacy settings.

In cases where you access our services through a third party, your data will be collected, used, and shared in line with their privacy policies and other terms agreed.

We could also acquire information from Third Parties with whom we do business or have a legal agreement. This includes business partners, subcontractors for our technical, payment, and delivery services, advertising networks, analytics providers, or search information providers.

The Information We Collect Through Automated Means

When you access the Services, we automatically collect certain information. This includes System Data, which is about your computer or device, such as your IP address, device type, operating system type and version, unique device identifiers, browser, browser language, domain, and other systems data. We also collect usage data about your interactions with the Services, such as the number of times you have accessed a meditation, the length of time you have spent on the Service, the pages you have visited, and other similar information.

With your express consent, we may additionally gather certain information through Google Fit and/or Apple Health.

Apple HealthKit

We utilize Apple’s HealthKit framework, which acts as a central repository for health and fitness information on the iPhone and Apple Watch and enables app communication with the HealthKit store with your express authorization. We may collect and handle your heart rate data with your express permission if you download and use the Apple Watch version of the Application. This information is gathered via the HealthKit framework and the Apple CoreMotion processor. The HealthKit framework may receive new data properties, which will be represented in the Application. We need your permission to access and use it.

We do not employ data collected via the HealthKit framework for marketing or other comparable activities. The Company and the Company’s analytics service providers may analyze engagement data for research reasons. We use it to deliver a customized experience and encourage involvement in healthy behaviors. You always have a choice to modify the settings on your mobile device to prevent us from seeing your data.

If you give the Application access to HealthKit, it will be able to contribute data to some regions of HealthKit. For example, it will be able to add the number of minutes the User is listening during meditation to the Awareness Times portion of HealthKit.

Google Fit

We use Google’s Fit SDK, an open platform that gives consumers access to and control of their fitness data. We do not obtain or handle any Google Fit data. However, the Google Fit framework may receive new data characteristics, which will be shown in the Application, and you must provide your approval. For example, the minutes of meditation that the User is listening to in the Application will be added to the Awareness Time area of Google Fit if we decide to add information to that portion of Google Fit.

Additionally, we use cookies to keep you logged in, maintain your preferences, access information when you sign in, and retain a small amount of behavioral data. Please consult our Cookie Policy for more details regarding cookies.

What We Use Your Information For?

The personal data collected as provided for under the terms of this document can be processed to:

  • Create, enhance, modify, offer, and manage the Services, including the presentation of personalized content
  • Fulfill your requests and orders for particular products, services, features, or information
  • Communicate with you about the Services and address your inquiries, requests, and issues
  • For administrative communications and information, such as team messages, alerts of updates to our Service, and modifications to our agreements
  • Sending you emails informing you how your meditation practice is doing, rewards programs, new services, new features, advertisements, newsletters, and other items and services that are accessible to you. You have the option to stop receiving these emails at any time.

  • Giving you the chance to participate in user-generated material
  • Managing your profile preferences

Profile Data, System Data, and Usage Data will be kept in our secured database for a period of 1 (one) year after the User deletes the Application or terminates membership. This helps speed up the process and ensure user satisfaction if a former member of the Application later decides to re-join.

Who Do We Need to Share Your Information With?

By using our services, you expressly agree that the Company may share your information with third parties for the purposes described in this privacy statement. Additionally, you consent to the possibility of sharing your information with:

Service Providers, Contractors, and Agents: To process payments, analyze data, provide marketing and advertising services (including retargeted advertising), host emails, provide customer service and support, and other services, we share your data with third parties. These service providers have access to your personal information. They are obligated to use it only to carry out the requested Service as instructed by us. We reserve the right to transfer your information to servers anywhere in the world, including outside your residence nation.

Analytics and Data Enrichment Services: We exchange specific contact information, Profile Data, System Data, Usage Data, or de-identified data as necessary as part of our use of third-party analytics techniques, like Amplitude and data enrichment services. De-identified data is information from which your identifiable information like email and name has been deleted and replaced with a token ID. This enables the suppliers to offer analytics services or compare your data to information from publicly accessible databases (including contact and social information from other sources). We do this to have more effective and personalized communication with you.

Power Social Media Features: social media features, like the like button on Facebook, can allow third-party social media channels to collect your information. This includes details like the pages of the Service you visit and the device IP address. They can also set a cookie to enable such a feature. Please note that the third-party’s privacy policies regulate your interactions with the features.

Administer Promotions and Surveys: We could share your information to facilitate marketing, administration, and sponsoring of our promotions and surveys you opt to partake in. The use follows the Privacy policy or the survey/promotion’s rules.

Advertisers: We may use and share specific System and Usage Data with third-party advertisers and networks if we decide to offer advertising in the future. This is so they can display general demographic and preference data regarding our users. We may also permit advertisers to gather System Data using automated data collection tools, such as cookies, tags, scripts, personalized links, device or browser fingerprints, and web beacons (collectively called “Data Collection Tools”). These advertisers may use this information to deliver targeted advertisements, enhance your user experience (through behavioral advertising), and conduct web analytics. Additionally, advertisers might provide us with the information they have on you. Please note that you will still receive generic adverts if you want to opt out.
